the homeowners of Ingleside Woods Subdivision
Our
2015 annual meeting for the Ingleside Woods Home Owner’s Association (IWHOA) is
scheduled for Tuesday, April 28st from 6pm sharp to 7pm sharp
in the Fickling & Company building at 2960 Riverside Drive. Please park
in the back parking lot and come in the back door. I will make sure the
door is open by 5:30 pm, so that we will not have a situation similar to last
year with the doors being locked and people having to wait outside. We will need 47 of our 140 homeowners to be
in attendance or to submit the enclosed proxy in order to have the quorum
required by our By Laws in order to conduct any business.
Our
annual meeting will be conducted in accordance with “Robert’s Rules of
Order”. Thus, our meeting will be
orderly and our participants courteous.
Everyone will have an opportunity to propose a motion, to speak in
support of or in opposition to any motion (for a maximum of 3 minutes per
person) and any matters that are brought before the group will be decided
democratically. If any homeowner has
parliamentarian experience, I especially invite you to attend and assist. Enclosed please find the agenda for this
meeting.
As
we will not have a significant amount of time to take and respond to specific
questions or concerns of an individual nature at this meeting, please send all
your individual questions and concerns to us for review prior to the
meeting. You can do this by mailing them to Ingleside Woods

A
copy of your timely questions and a response to those questions by the Board of
Directors will be provided to everyone during the meeting. This
information will also be posted to our blog at www.inglesidewoods.org,
where the IWHOA budget, expense itemizations, By Laws and Restrictive Covenants
may also be viewed.
We
are in need of a volunteer for the position of Treasurer for our association as
our long term and faithful Treasurer, Margo Kenirey, has purchased a new home
and her home in our subdivision is for sale. All volunteers for Treasurer will be properly
vetted as we have several thousand dollars in our bank account. Nominations from the floor will be accepted
for the position of President. (I agree
to serve only until the homeowners of Ingleside Woods desire a change in
leadership.) Our current Secretary is
Michelle Stanley.
Enclosed
please find the Treasurer’s report for the IWHOA for 2014. Please review it carefully to insure that you
understand how your dues are being spent.
Please call or contact me if you have any questions and/or concerns with
anything in the Treasurer’s report.
Also
attached, please find a list of those property addresses whose owners are $200
or more in arrears on the payment of their HOA dues. I and no other person made
the decision to publish this list to indicate those residents who are not
contributing financially to the betterment of our community. Property liens will be filed against the
homes reflected on the list beginning July 1, 2015 if the full amount owed is
not paid by then. (Your name is not on this list if you are only delinquent on
your 2013 and 2014 dues and you still owe 2015.)
Every
property owner in Ingleside Woods is a member of the IWHOA by virtue of their purchase
of property in Ingleside Woods. The only exception is Mr. Hadaway’s
property at 3111 Stinsonville Road, as that home was here before there was
an Ingleside Woods. All other homeowners
are members and must pay dues, as those properties were deeded subject to
recorded By Laws and Restrictive Covenants by the original developer of
Ingleside Woods, David Thornton. If you didn’t know this, it is your
fault alone.
The
reason that Mr. Thornton recorded these Restrictive Covenants for all phases of
Ingleside Woods was to maintain the visual appeal, value, aesthetics and the
resale potential of properties in the subdivision. Restrictive Covenants help all of us maintain
the value in our homes and in our community as a whole. These benefits continue to exist today in
support of all of our Restrictive Covenants.
Speaking
of Restrictive Covenants, several of our homeowners appear to be unconcerned that
there is a Restrictive Covenant prohibiting the parking on the street of any
vehicle for more than 8 hours at a time and a prohibition against the parking
of trailers and boats outside of their home’s garage (or otherwise not screened
from view from any street in the subdivision). I have mailed post cards and made personal
visits to those homes where I have observed non-compliance with these
particular Restrictive Covenants with varying degrees of success. (If you can’t park in your garage because of
“stuff” or cannot go up your driveway, or have too many vehicles for your
garage and driveway combined, it is not the fault of the IWHOA.)
Consequently,
at a recent meeting of your IWHOA Board of Directors, it was decided that a
fine of $1 per day per vehicle or trailer will be implemented beginning July 1,
2015 for violations of the prohibition against the parking of vehicles on the
street for more than 8 hours and for the parking of any trailer or boat on any
lot when that trailer or boat is visible from any street in the subdivision.
This
grace period will give ample opportunity to those homeowners not yet in
compliance with the Restrictive Covenants, to make arrangements to become
compliant. Accumulated unpaid fines
will result in property liens in favor of the IWHOA. As your President, I will monitor
compliance and seek to increase the dollar amount of fines if a fine of only $1
per day is not effective in achieving compliance.
Tenants
and property owners alike must comply with all applicable Restrictive
Covenants. If you rent your property or
have roommates, please make sure that you inform your tenants or roommates of
all of our Restrictive Covenants for the betterment of the entire subdivision. Any tenant behavior resulting in fines will cause
those fines to be assessed against the homeowner.
If
you would like to see any changes made to the recorded Restrictive Covenants of
Ingleside Woods, please first obtain the approval of Mr. Thornton’s son, Tim
Thornton of Thornton Real Estate, and then obtain the signatures of 75% of the
homeowners in Ingleside Woods. This is
the only process with which I am familiar for our Restrictive Covenants to be
amended. I know this not because I am an
attorney, but because I can read. If you
have never read your By Laws or your Restrictive Covenants, please do so now.
If
you would like for our Restrictive Covenants to be ignored and unenforced and
for the dues of non-paying homeowners to remain uncollected, you will need to
elect a new President. It is my intent
to achieve compliance with all Restrictive Covenants and to collect delinquent
dues as permitted by law.
Lastly,
it is my desire for mutual consideration and courtesy among the homeowners of
Ingleside Woods. Provide no cause for your neighbors to have the
slightest irritation or aggravation because of your actions or those of your
family, children, pets or guests. (For
example, if you have a dog and you leave it outside 24/7 to bark and irritate
your neighbors, I really don’t know why you have a dog.) Seek ways to avoid any action or activity that
your neighbors might consider a disturbance, an inconvenience, an eyesore or a nuisance.
If
you will not be able to attend our annual meeting, but you desire to insure a
quorum and desire to entrust me with your proxy, please sign, date and mail the
enclosed proxy back to me at my address below or to the P.O. Box of the IWHOA.
